Evictions planned over mosque vandalism

Bottles dropped from private apartments

TUCSON, Ariz. - Some University of Arizona students are putting lives at risk.

Now a company that operates some private apartments is taking steps to stop the danger.

Residents at the Sol Y Luna private apartments have been dropping bottles on the Islamic Center.

Now the building owner is moving to evict the culprits.

People from the Islamic Center say falling bottles have barely missed them and barely missed children playing outside the Center.

It's not a new problem either. Surveillance video caught falling bottles three years ago. The building owners tracked down and evicted the culprits them.

The area is in Councilmember Steve Kozachik’s Ward. He says the owners are working to evict the culprits now. He says the owners don't seem to be making it clear enough that the lease makes it an eviction offense if a tenant drops anything off the balcony or they fail to stop a guest from dropping something.

Kozachik thinks it's no accident this is happening to the Islamic Center.

"We have had Israeli flags hung over the balconies. We have had epithets yelled down at the folks below at the Islamic Center. I believe that the people are being targeted for who they are. In this political climate we can't afford to have anything but a zero tolerance reaction to that."

Apartment residents we talked to say they have been warned they'll be fined or evicted if they drop things off balconies.

Ryan Byrne says, “It's not the people who live here. A bunch of people come as guests of people having parties, get all crazy and throw stuff off the balconies and unfortunately the people get penalized for it."

But he says fines or evictions are the right reaction if someone drops dangerous things off a balcony or does not stop a guest from dropping them.

The building owners have not responded to our requests for an interview.

We talked by phone with the chairman of the Islamic Center.

He's sorry to hear the students being evicted have made trouble for themselves. But he says falling bottles nearly hit him.

He wants this behavior prevented before someone is hurt or killed.
