South Tucson is fighting in court to keep a planned rehab facility from opening across the street from an elementary school.

Pasadera Behavior Health Network bought the building at 2820 S. 8th Ave., which is across the street from Mission View Elementary School, 2600 S. 8th Ave. The city denied Pasadera's permit, and the organization challenged the move in court.

On Thursday, Pima County Superior Court judge Jeffrey T. Bergin granted a stay to one count of the facility's efforts to get the court to allow the facility to open.

As many as 70 people would be treated at the facility.

The next hearing in the case is a status conference scheduled at 9:30 a.m. May 16.
