Man takes plea, gets no jail time in death of brother

A man accused of killing his brother received three years probation as part of a plea deal that accepted him as guilty of a lesser charge.

Schmedding pleaded guilty to solicitation to possess a deadly weapon by a prohibited possessor.

Police say Julian Schmedding wasinvolved in a crime with his brother, 15-year-old Jonathan Schmedding, and two others that resulted in Jonathan's death in August 2016. 

Julian and Jonathan Schmedding with Roy Lee Brown and Jesse King allegedly robbed another group of four individuals. Police say Roy Lee Brown pulled out a hand gun. 

Detectives say Brown fired several rounds at the other four individuals, who ran away from them.

Johnathon was struck and killed by one of the rounds that was fired by Brown.

According to the law, when suspects take part in a crime that leads to the death of a co-conspirator, they can be charged with murder.

Schmedding and Jesse King were arrested on first-degree murder charges in connection with the incident.
