Attorney Marc Victor told ABC15 that County Attorney Bill Montgomery personally told him Tuesday that his office would re-look at the case.

Victor represents Johnny Wheatcroft, who is suing Glendale police over the actions of Officer Matt Schneider and two other policemen.

A MCAO spokesperson said the office didn’t have information to provide in response to a request for comment. However, the spokesperson asked if the office could have ABC15’s video of the body camera footage.

A decision to re-look at the case would come after an October 2017 decision by the County Attorney’s Office to turn down a prosecution of Officer Schneider.

Wheatcroft was handcuffed lying face down on the hot asphalt on a 108-degree day. He'd already been tased 10 times, with one officer kneeling on his back as Schneider kicked him in the groin and pulled down his athletic shorts to tase him a final time in his testicles, according to a federal lawsuit and body camera footage obtained by ABC15.
