Some people are pretty miffed they haven't been able to try the new chicken sandwich at Popeyes, but perhaps none more so than one Tennessee man who is using the court system to express his outrage.

Craig Barr of East Ridge, Tennessee, is suing Popeyes for being sold out of chicken sandwiches, WTVC reports.

According to the civil summons filed in Hamilton County General Sessions Court, Barr is suing for "false advertising, deceptive business practices by entity to public. Countless time wasted driving to and from Popeyes. No chicken sandwich. Was told to come back this day- still no sandwich."

According to WTVC, Barr responded to a Craigslist ad from an alleged Popeyes worker who said they would "stash" the sandwiches and sell them to customers who paid $24.

Barr says the person who posted the ad took his money but never delivered on the sandwiches.

It's no surprise that Barr is unable to get his hands on the coveted chicken sandwich. Popeyes announced Tuesday that "extraordinary demand" for the chicken sandwich has led to it being sold out — and it only took two weeks since its nationwide debut August 12.

"As a result, Popeyes restaurants across the country are expected to sell out of the Chicken Sandwich by the end of this week," the company said in a statement. Many stores have already sold out.

The chicken sandwich seeker is asking for $5,000 and was assigned an October 28 court date.
