UPDATE: Man shot by Border Patrol agent near Arivaca Road on Tuesday morning charged

UPDATE (1/28):

Federal prosecutors have filed a criminal complaint against Patrick Gary Schlegel in U.S. District Court, charging him with assault on a federal officer, prohibited possession of a firearm, and transportation of an illegal alien.

According to the U.S. Attorney’s Office, Schlegel allegedly fired at a manned U.S. Customs and Border Protection helicopter during a human-trafficking pursuit near Arivaca, prompting a Border Patrol agent on the ground to return fire.

Prosecutors also say Schlegel was wanted on a federal warrant for escape from custody, has prior felony convictions, including alien smuggling, and is the subject of an order of protection in Pima County.

The FBI’s Tucson office is leading the investigation with assistance from the Pima County Sheriff’s Department and CBP.

UPDATE (4:55 p.m.):

In a press conference held on Tuesday afternoon, the suspect in Tuesday morning's shooting was identified by the FBI as 34-year-old Patrick Gary Schlegel.

According to the Pima County Sheriff Chris Nanos, Schlegel was being pursued by a Border Patrol agent for an earlier incident involving alleged human trafficking.

Agents recognized his vehicle and made a traffic stop, Nanos said. During that that time, Schlegel fled on foot. The agent chased after him on foot.

Schlegel allegedly fired shots at a manned CBP helicopter, according to Heith Janke, Special Agent in Charge (SAC) for the Federal Bureau of Investigation (FBI) Phoenix Field Office. Agents returned fire and Schlegel was struck.

Schlegel was hit and was transported to a Tucson hospital. He is in serious but stable condition, Nanos said.

Janke said Schlegel is being charged with assault on a federal officer, alien smuggling and felon in possession of a firearm.

UPDATE (1:12 p.m.): The FBI tells KGUN 9 that they are investigating the incident, described as an "alleged assault on a federal officers that occurred around 7 a.m."

UPDATE (12:37 p.m.):

Pima County Sheriff's Department has issued a news release confirming that the shooting involved a U.S. Border Patrol agent.

According to the news release, the request for assistance was made by the FBI earlier in the day.

PCSD is conducting an investigation and has been asked to lead the use-of-force investigation involving the agent.

Santa Rita Fire and American Medical Response responded to reports of a shooting in the area of milepost 15 on West Arivaca Road Tuesday morning.

Crews found one patient in custody and in critical condition, according to a news release from SRFD.

The patient was transferred to a local medical helicopter for rapid transport to a regional trauma center.

The incident remains under active investigation by law enforcement agencies.
