SCOTTSDALE, Ariz. (AP) - The Maricopa County Attorney's Office won't pursue the case against the man who allegedly held his girlfriend hostage in a sex dungeon at his Scottsdale home.

Prosecutors filed a motion Monday to dismiss without prejudice the charge of kidnapping against 48-year-old Jason Monroe Smith.

They can refile the charge later should they receive new evidence or testimony.

According to Scottsdale police, Smith met the victim on a dating website and moved her into his house that has a sex dungeon with medieval stocks, chains, whips and other blunt weapons.

Smith allegedly whipped and shocked the woman from February until May when she escaped.

Police arrested Smith on May 8.

The woman later told investigators that she consented to the activity and wanted prosecutors to drop the case.
