A former Senior Commander in the Pima County Sheriff's Department filed a notice of public authority defense.
Back in November, Pima County Deputy Chief Chris Radtke, who was indicted on money laundering and theft charges.
The filing means Radtke doesn't believe he's to blame because he was following orders.
The motion could delay the start of his trial scheduled to begin on January 24.
