The City of Bisbee will be moving forward with a lawsuit against the State of Arizona.
Tuesday night the Bisbee City Council made a unanimous decision to suspend their plastic bag ordinance that went into effect in 2013.
Arizona Senator, Warren Peterson out of Mesa filled a request with the Attorney General to investigate the plastic bag ordinance to determine it's validity.
The state threatened to strip the City of Bisbee of their state funding of about 2 million dollars.
The city argued that plastic bags are unnecessary and not properly disposed.
Councilwoman Anna Cline says there were folks in town that converted to the new way but others not so much.
No word yet when the city will file their lawsuit, but the suspension buys them time.
