Arizona Supreme Court to consider utility regulatory issue

PHOENIX (AP) - The Arizona Supreme Court has agreed to review a lower court's ruling that the Arizona Corporation Commission had the authority to appoint a manager to oversee a Pinal County utility's operations.

The state high court said Wednesday it will schedule arguments on Johnson Utilities' appeal of a March 7 ruling by the state Court of Appeals.

The company had argued that the commission's action interfered with the company's internal management, but the Court of Appeals said the commission had broad ratemaking power under the Arizona Constitution.

According to the appeals court, that power gave the commission authority to impose an interim manager under appropriate circumstances.
