Senate to vote on bill to pre-empt feds

The Senate plans to vote on a measure that would allow the state to vote on bills blocking authorities from enforcing or financing any federal action not affirmed by Congress.

Republican Rep. Bob Thorpe of Flagstaff says he wants Arizona to have the option to nullify rules and laws that could be unconstitutional. Republicans annually attempt similar legislation.
 
Thorpe sponsored the measure that would let the Legislature pass bills to prevent state agencies, cities and counties from cooperating with rules and regulations proposed by federal agencies or executive orders.
 
Democratic Sen. Andrew Sherwood opposes the measure saying the state does not have the authority to call federal policy unconstitutional.
 
The Senate is set to vote on House Bill 2201 Tuesday afternoon.
