Woman arrested for violation of Medical Marijuana Act

SIERRA VISTA, Ariz. (KGUN9-TV) - The Sierra Vista Police Department has arrested Mary Brown, 47 of Sierra Vista for violation of the Medical Marijuana Act.

Cpl. Scott Borgstadt tells KGUN9 that on December 7, officers responded to a home on West Martin Drive for a domestic violence call.

While officers where on scene, they learned both individuals involved had cultivation medical marijuana cards and were growing marijuana in a back bedroom.  Arizona law allows for an individual to cultivate up to 12 plants. The legal allotment for this residence was 24 plants.
 
Officers counted 25 plants inside the residence and 6 plants outside the residence. They also noticed 7 empty pots in the Marijuana room with agitated soil.

Police investigation determined that Brown had ripped 6 plants out of their pots and put them outside the house prior to law enforcement arrival.
 
Based on information obtained and the violation of the Medical Marijuana Act, officers obtained a search warrant for Brown's residence.

Brown was arrested and charged with: possession of marijuana, possession of drug paraphernalia, production of marijuana and tampering with evidence.
