FLDS bishops appeal ruling to Utah Supreme Court

Associated Press - September 9, 2009 6:14 PM ET

SALT LAKE CITY (AP) - Two polygamous church bishops are asking the Utah Supreme Court to overturn a district court's decision that they claim denies them their constitutional right to carry out their ecclesiastical duties.

Lyle Jeffs is the bishop for Hildale, Utah, and Colorado City, Ariz. His brother, Warren Jeffs, is the jailed prophet of the Fundamentalist Church of Jesus Christ of Latter Day Saints.

James Oler heads the faith's Bountiful, British Columbia branch. As bishops they are expected to provide for the spiritual and physical needs of church members.

Both men sought to intervene on behalf of the FLDS in a 3rd District Court dispute over a church land trust under state control since 2005.

In July, a 3rd District Court Judge Denise Lindberg rejected their request.
