FLAGSTAFF, Ariz. (AP) - A federal judge dropped an assault charge against a Navajo Nation, Tyson Bigman, without prejudice.

The judge granted the motion issued by prosecutors because Tyson Bigman had not been indicted, a requirement for the case to move forward.

Authorities say that Bigman's father, Victor Bigman, aided his son during a fight with police by fatally shooting Sgt. Darrell Curley.

Curley managed to wound Victor Bigman who is in the hospital facing a murder charge.
